What is Mini-Tort?

Mini-tort is a Michigan auto insurance law that allows a driver who is not at fault in an accident to recover out of pocket vehicle repair costs from the at-fault driver.

This applies when your vehicle damage is not fully covered by your own insurance policy.

How Much Can You Recover with Mini-Tort?

As of current Michigan law, mini-tort allows you to recover up to $3,000 for vehicle damage from the at-fault driver.

This amount typically applies to:

  • Your deductible
  • Repairs not covered by your collision coverage
  • Damage when you do not carry collision insurance

When Does Mini-Tort Apply?

Mini-tort may apply if:

  • You were not at fault for the accident
  • The other driver was at least 50% at fault
  • Your vehicle damage was not fully covered by your insurance
